1. Agreement to Terms

These Terms and Conditions constitute a legally binding agreement made between you and SaaSMotion LLC ("we," "us," or "our"), a company registered in Slovenia, concerning your use of the Audio Dreams application and website (collectively, the "Service").

2. Service Description

Audio Dreams is a bedtime story creation and delivery service. The Service offers both free and paid subscription features. Free users can access and read existing stories, while paid subscriptions enable story generation capabilities.

3. Subscription Plans

We offer the following paid subscription plans:

  • Basic Plan: Allows generation of up to 10 stories per month
  • Standard Plan: Allows generation of up to 60 stories per month
  • Premium Plan: Allows generation of up to 120 stories per month

Each generated story includes a cover image, text content, and audio narration. Unused story generations do not roll over to the next month.

4. User Eligibility and Account Creation

To create an account and purchase subscriptions, you must be at least 16 years of age (or the age of legal majority in your jurisdiction, whichever is higher). While the Service's content is suitable for users of all ages, accounts can only be created by individuals who can form a legally binding contract.

Parents or legal guardians may create accounts to access the Service on behalf of their children. By doing so, you agree to:

  • Be responsible for all charges and activities associated with the account
  • Supervise and be responsible for your child's use of the Service
  • Ensure your child's use complies with these Terms

5. Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Provide accurate and complete information when creating your account
  • Update your account information to keep it current
  • Notify us immediately of any unauthorized access or use of your account
  • Ensure you sign out from your account at the end of each session

6. Intellectual Property Rights

All stories generated through the Service, including their text content, audio narrations, and cover images, remain the exclusive property of SaaSMotion LLC. Your subscription grants you a limited, non-transferable, non-exclusive license to access and use the stories for personal entertainment purposes only.

Users may not:

  • Download, copy, or store stories locally
  • Share, distribute, or resell stories
  • Modify or create derivative works based on the stories
  • Use the stories for commercial purposes
  • Remove any copyright or other proprietary notices from the stories

7. Content Standards and Moderation

Audio Dreams is committed to providing a safe, family-friendly environment. All generated stories are:

  • Automatically moderated using AI technology
  • Filtered to ensure content is suitable for children
  • Monitored for compliance with our content guidelines

The Service employs strict content generation parameters to prevent the creation of:

  • Inappropriate or adult content
  • Violence or graphic content
  • Discriminatory or harmful content
  • Any other content unsuitable for children

8. Subscriptions and Payments

Subscription payments and management are handled through your device's app marketplace (Apple App Store or Google Play Store). By subscribing to Audio Dreams, you agree to:

  • Pay all subscription fees associated with your chosen plan
  • Manage your subscription (including cancellation) through your device's app marketplace
  • Accept that no refunds will be provided for any subscription payments
  • Acknowledge that unused story generations do not roll over to the next billing period

Please note:

  • There are no free trial periods offered
  • Subscription fees are charged according to your chosen plan (Basic, Standard, or Premium)
  • Your subscription will automatically renew unless cancelled through your device's app marketplace
  • Cancellation must be performed at least 24 hours before the end of the current subscription period to avoid renewal charges

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes via the email address associated with their account. Continued use of the Service after such modifications constitutes acceptance of the updated Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Slovenia and applicable European Union regulations. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Slovenia.

11. Data Protection and GDPR Compliance

We process personal data in accordance with the General Data Protection Regulation (GDPR) and applicable data protection laws. Our processing activities are detailed in our Privacy Policy, which forms part of these Terms. Under the GDPR, you have the following rights:

  • Right to access your personal data
  • Right to rectification of inaccurate data
  • Right to erasure ("right to be forgotten")
  • Right to restrict processing
  • Right to data portability
  • Right to object to processing

12. Limitation of Liability

To the maximum extent permitted by law:

  • The Service is provided "as is" and "as available" without any warranties, either express or implied
  • We do not guarantee uninterrupted, secure, or error-free operation of the Service
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability for any claims relating to the Service shall not exceed the amount you paid for your subscription in the twelve months preceding the claim

13. Service Availability and Maintenance

While we strive to provide continuous service, you acknowledge and agree that:

  • The Service may be temporarily unavailable for scheduled maintenance or unplanned technical issues
  • We reserve the right to modify, suspend, or discontinue any part of the Service at any time
  • We will make reasonable efforts to notify users of planned maintenance or significant changes
  • We are not liable for any service interruptions or data loss that may occur

14. Account and Data Deletion

You have the right to request deletion of your account and associated data. Here's how to request account deletion:

  1. Log into your Audio Dreams account
  2. Go to Account Settings
  3. Select "Delete Account"
  4. Confirm your decision by entering your password

Alternatively, you can email support@audiodreams.app with your account email and a request for deletion.

When you delete your account:

  • Your account information (email, stories, preferences) is permanently deleted within 30 days
  • Your generated stories and listening history are permanently deleted within 30 days
  • Payment records are retained for 7 years as required by financial regulations
  • Anonymous usage statistics may be retained indefinitely

Note: Deletion requests are permanent and cannot be reversed. Any active subscriptions should be cancelled through your device's app marketplace before requesting account deletion.
